By downloading, installing, or using the AIVO mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.
2. Description of Service
AIVO is a fitness and nutrition tracking application that provides:
- Workout planning and tracking
- Nutrition and macro logging
- AI-powered coaching and recommendations
- Progress tracking and analytics
- Social features and community interaction
- Integration with Apple HealthKit
Features may be added, modified, or removed at our discretion without prior notice.
3. Eligibility
You must be at least 13 years old to use AIVO. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.
- Age Verification: We verify your age during account creation by collecting your date of birth
- Minimum Age: Users under 13 are not permitted to create accounts (COPPA compliance)
- Parental Consent: Users aged 13-17 should have parental permission to use AIVO
4. User Accounts
4.1 Account Creation
- You must provide accurate, current, and complete information
- You are responsible for maintaining the confidentiality of your credentials
- You must notify us immediately of any unauthorized access
4.2 Account Responsibilities
- You are responsible for all activities under your account
- You may not share your account with others
- You may not create multiple accounts
4.3 Account Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse or harass other users
- Provide false information
5. User Content
5.1 Ownership
You retain ownership of content you create (workout logs, progress photos, posts, comments).
5.2 License Grant
By posting content, you grant AIVO a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content within the App for the purpose of operating and improving our services.
5.3 Content Guidelines
You agree not to post content that:
- Is illegal, harmful, or offensive
- Infringes on intellectual property rights
- Contains malware or harmful code
- Violates another person's privacy
- Is spam or promotional without authorization
- Contains explicit or inappropriate material
- Constitutes harassment, bullying, or hate speech
- Promotes violence or threatens harm
- Contains misinformation about health or fitness
5.4 Content Moderation
To maintain a safe community, AIVO implements content moderation:
- Reporting: Users can report content that violates our guidelines by selecting from categories including inappropriate content, spam, harassment, hate speech, violence, and misinformation
- Review Process: Reported content is reviewed by our team
- Automatic Actions: Content receiving multiple reports may be temporarily hidden pending review
- Enforcement: We may remove content, issue warnings, or suspend accounts that violate these guidelines
5.5 User Blocking
You have the ability to block other users:
- Blocked users' content will not appear in your feed
- Blocked users cannot interact with your posts
- You can unblock users at any time in your settings
- Blocking is private and not visible to the blocked user
6. Community Guidelines & Content Policy
AIVO is committed to maintaining a positive, supportive, and safe community for all users. By using our social features, you agree to follow these Community Guidelines.

- Safety: Prioritize the physical and mental wellbeing of yourself and others

6.2 Prohibited Content
The following content is strictly prohibited and will be removed:
Harassment & Bullying
- Personal attacks, insults, or name-calling
- Body shaming or negative comments about someone's appearance
- Mocking someone's fitness level or progress
- Targeted harassment or coordinated attacks
- Encouraging others to harass or bully someone
Hate Speech & Discrimination
- Content that promotes hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Slurs, stereotypes, or dehumanizing language
- Content promoting supremacist ideologies
Violence & Threats
- Threats of violence against individuals or groups
- Content glorifying or promoting violence
- Instructions for harmful activities
- Content promoting self-harm or suicide
Harmful Health Content
- Promotion of dangerous diets, extreme caloric restriction, or eating disorders
- Unverified medical claims or dangerous health advice
- Promotion of illegal performance-enhancing substances
- Content encouraging overtraining or ignoring injury
Inappropriate Content
- Sexually explicit or pornographic material
- Nudity (except appropriate fitness/progress photos)
- Graphic or disturbing images
- Content involving minors in inappropriate contexts
Spam & Deception
- Unsolicited advertising or promotional content
- Repetitive or low-quality posts
- Fake accounts or impersonation
- Misleading claims about products or services
- Pyramid schemes or scams
Privacy Violations
- Sharing others' personal information without consent
- Posting photos of others without permission
- Doxxing or revealing someone's identity
6.3 Reporting Violations
If you encounter content that violates these guidelines:
- Use the Report button on any post or comment
- Select the appropriate category for your report
- Provide additional details if helpful
- Do not engage with or retaliate against the violator
All reports are reviewed by our moderation team. We take every report seriously and will take appropriate action.
6.4 Enforcement Actions
Violations of these guidelines may result in:
- Content Removal: Violating content will be removed
- Warning: First-time or minor violations may receive a warning
- Temporary Suspension: Repeated or serious violations may result in temporary account suspension
- Permanent Ban: Severe or repeated violations will result in permanent account termination
- Legal Action: Illegal activity may be reported to law enforcement
6.5 Appeals
If you believe your content was removed in error or your account was unfairly suspended:
- Contact us at appeals@aivo.health
- Include your username and a description of the issue
- Appeals are reviewed within 5 business days
- Our decision on appeals is final
7. Prohibited Activities
You may not:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with the App's operation or security
- Scrape, harvest, or collect user data
- Impersonate another person or entity
- Circumvent any access restrictions
- Reverse engineer or decompile the App
- Use automated systems or bots
- Engage in harassment or bullying
- Sell or transfer your account
8. Health Disclaimer
IMPORTANT: AIVO IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

- AIVO provides fitness and nutrition information for educational purposes only
- Information provided is not medical advice, diagnosis, or treatment
- Always consult a qualified healthcare provider before starting any fitness program
8.2 AI Recommendations
- AI-generated suggestions are based on algorithms and general fitness principles
- They may not be suitable for your specific health conditions
- Individual results may vary
- Do not rely solely on AI recommendations for health decisions
8.3 Exercise Risks
- Physical activity carries inherent risks
- You exercise at your own risk
- Stop immediately if you experience pain, dizziness, or discomfort
- Consult a physician if you have any medical conditions
9. Intellectual Property
9.1 Our Property
The App, including its design, features, content, and trademarks, is owned by AIVO and protected by intellectual property laws.
9.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
10. Third-Party Services
10.1 Apple HealthKit
- HealthKit integration requires your explicit permission
- Data accessed from HealthKit is governed by Apple's policies
- We comply with Apple's HealthKit guidelines
10.2 Firebase/Google Services
We use Google Firebase for authentication and data storage. Use is subject to Google's Terms of Service.
11. Premium Subscription
11.1 Pricing
- AIVO Premium Monthly: $9.99/month
- AIVO Premium Annual: $79.99/year
- Prices may change with notice
11.2 Billing
- Subscriptions are billed through Apple's App Store
- Payment is charged at confirmation of purchase
- Subscriptions auto-renew unless cancelled 24 hours before the renewal date
11.3 Cancellation
- You may cancel at any time through App Store settings
- No refunds for partial subscription periods
- Access continues until the end of the billing period
12. Limitation of Liability
12.1 Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12.2 Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits or data
- Personal injury or property damage
- Unauthorized access to your data
- Errors or interruptions in service
13. Indemnification
You agree to indemnify and hold harmless AIVO, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
15. Changes to Terms
We may update these Terms at any time. We will notify you of significant changes through:
- In-app notification
- Email notification
- Updated "Last Updated" date
Your continued use after changes constitutes acceptance of the modified Terms.
16. Dispute Resolution
16.1 Governing Law
These Terms are governed by the laws of the State of California, USA.
16.2 Arbitration
Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
16.3 Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions.
17. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and AIVO.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- Waiver: Failure to enforce any right does not constitute a waiver.
- Assignment: You may not assign your rights under these Terms. We may assign our rights freely.
